Terms of Use

These Terms of Use (hereinafter — the “Terms”) govern access to and use of the website kaplia.pro (hereinafter — the “Site”) and the client portal clients.kaplia.pro (hereinafter — the “Portal”). Together, the Site and the Portal are referred to as the “Services”.

The owner of the Services is Individual Entrepreneur Kaplia Vitalii Vitaliiovych (Ukraine, 08520, Kyiv region, Borova, Sosiury St. 2), hereinafter — the “Owner”.

By using the Services, you confirm your agreement to these Terms. If you do not agree with any provision, please stop using the Services.

How to read this document: Part I applies to all users. Part II covers the public Site only. Part III covers the Portal only and applies to the Owner’s clients.

The Short Version

This is a plain-language summary for convenience. It does not replace the full text below — in case of any discrepancy, the full text prevails.

  • The kaplia.pro website is open to everyone; the client portal is available to authorized clients only.

  • Site materials are protected by copyright: copying or reusing them without written consent is not allowed.

  • The AI assistant answers automatically. Its replies are informational, not an offer — pricing and timelines are confirmed only in direct communication.

  • In the portal you can see your websites, domains, and backups, pay for services (LiqPay or PDF invoice), and contact support.

  • Refunds are possible within 14 days if the service has not been activated yet. Registered domains are non-refundable.

  • Downloaded backups may contain license keys — they must not be shared with third parties.

  • Your data is processed under the Privacy Policy and is never used for advertising.

Part I. General Provisions

1. Scope and Acceptance of the Terms

1.1. These Terms constitute a public agreement between the Owner and every user of the Services.

1.2. Use of any of the Services means full and unconditional acceptance of these Terms in their current version.

1.3. Individual sections of this document apply depending on which Service you use.

2. Content and Copyright

2.1. All materials of the Services (texts, images, design, logos, structure, program code) are the property of Individual Entrepreneur Kaplia Vitalii Vitaliiovych or are used on legal grounds.

2.2. Any reproduction, copying, distribution, or other use of the materials is permitted only with prior written consent from the Owner.

3. Limitation of Liability

3.1. The Owner makes efforts to ensure the stable operation of the Services but does not guarantee the absence of technical errors or temporary disruptions.

3.2. The Owner is not responsible for:

  • temporary unavailability of the Services, technical failures, and errors;

  • disruptions in the hosting provider’s servers or force majeure circumstances;

  • failures of third-party services (LiqPay, Google, Cloudflare, OpenAI, hosting providers);

  • loss of access or data caused by the user’s own actions;

  • consequences caused by external factors (viruses, malware, actions of third parties);

  • any damages arising from the use or inability to use the Services.

3.3. The Owner maintains an appropriate level of technical security but cannot guarantee absolute protection against external threats.

4. Links to Third-Party Resources

4.1. The Services may contain links to third-party web resources. The Owner is not responsible for their content, privacy policies, or security.

5. Confidentiality and Personal Data

5.1. Personal data is processed in accordance with the Privacy Policy, which forms an integral part of these Terms.

5.2. By using the Services, the user agrees to the terms of personal data processing.

6. Changes to the Terms

6.1. The Owner reserves the right to change these Terms at any time without prior notice.

6.2. The current version is always available on this page with an updated date, as well as via the link in the footer of the Site and the Portal.

Part II. The Public Site kaplia.pro

7. Use of the Site

7.1. The user agrees to use the Site solely for legal purposes, without violating the rights of the Owner or third parties.

7.2. It is prohibited to:

  • copy, distribute, or use content without the Owner’s written consent;

  • interfere with the operation of the Site, attempt to bypass security systems, or gain unauthorized access;

  • send harmful, false, or spam information through feedback forms.

8. Feedback Forms

8.1. By sending a message through feedback forms, the user voluntarily provides their personal data and agrees to its processing in accordance with the Privacy Policy.

8.2. The provided data is used solely for communication and service provision purposes.

9. AI Assistant

9.1. The Site offers a chat with an AI assistant in text and voice modes. Responses are generated automatically by artificial intelligence based on the published content of the Site.

9.2. The assistant’s responses are for informational purposes only, may contain inaccuracies, and do not constitute an official offer, professional advice, or a guarantee. Terms of cooperation, pricing, and timelines are confirmed only in direct communication with the Owner.

9.3. To start a conversation, the user enters their name and phone number, thereby agreeing to the processing of this data in accordance with the Privacy Policy.

9.4. It is prohibited to use the assistant to send harmful, offensive, or spam content, or to attempt to bypass the service’s restrictions. The number of requests may be limited technically.

9.5. The Owner may suspend or restrict access to the assistant at any time, particularly in cases of abuse.

10. Use of Cookies

10.1. The Site uses cookies for proper functioning, analytics, and improving user experience.

10.2. Continuing to use the Site means agreeing to the use of cookies.

10.3. Detailed information is provided in the Privacy Policy.

Part III. The Client Portal clients.kaplia.pro

11. Purpose of the Portal

11.1. The Portal was created to simplify interaction between the Owner and clients, and allows users to:

  • view information about connected services: websites, domains, mailboxes;

  • view the account expiration date and receive renewal reminders;

  • download website backups, databases, and working archives of GitHub repositories;

  • renew services through integrated payment providers;

  • submit requests to technical support;

  • fill in a brief to order a new website;

  • access related services (the Planka project manager, mail, etc.).

11.2. The Portal is not a public service or a social network. Access is granted to authorized users only.

11.3. Users can view the history of successful payments made through the Portal in their profile. The information is displayed as a list of transactions with the date, amount, and service type.

11.4. In the “My services” section, a button to open the site’s admin panel may be displayed for each connected website. The Portal automatically detects the site type and, for WordPress, shows the current admin panel URL (including changed or hidden addresses used for security). If the site is not a WordPress project or the address cannot be determined, the button is not displayed.

11.5. The Portal is an abstraction layer for managing services. Deleting an account in the Portal does not delete the user’s actual resources (websites, domains, mailboxes, backups), as they are stored on the hosting.

12. Registration and Access

12.1. Registration is performed automatically upon the first authorization in the Portal.

12.2. Access is possible via:

  • email authorization;

  • Google OAuth authorization;

  • Google One Tap (where supported by the browser).

12.3. Cloudflare Turnstile captcha protection is used during sign-in.

12.4. The user agrees to provide accurate contact details, not to share access with third parties, and to keep their credentials secure.

12.5. The Owner may suspend or restrict access in case of suspicious activity, violation of these Terms, or a threat to the security of the Portal or users’ resources.

13. User Obligations in the Portal

The user agrees to:

  • use the Portal solely to access their own resources;

  • not interfere with the operation of the Portal or perform unauthorized actions;

  • not attempt to access other users’ resources;

  • maintain the confidentiality of information obtained through the Portal, including files, backups, and repositories.

14. Downloading Files, Backups, and Repositories

14.1. The Portal allows downloading working website archives, working database copies, and working archives of GitHub repositories without commit history.

14.2. Downloaded files may contain the Owner’s internal technical data: configurations, service keys, and the license data of the ACF and WPML plugins provided to users hosted on the Owner’s hosting.

14.3. The user agrees not to share such data with third parties and not to use it outside their own project.

14.4. The Owner is not responsible for consequences related to the user’s improper use of downloaded materials.

14.5. Viewing and downloading attached files and private links. Personal files or internal links provided by the Owner within the scope of cooperation (documentation, additional materials, instructions, logins and passwords, working files, etc.) may be attached to an account. Access rights:

  • users with access to the account can view or download such files;

  • access is possible only after authorization in the Portal;

  • other Portal users without access to this account cannot view or download these materials.

The user agrees not to share such files with third parties without the Owner’s permission.

15. Payments and Service Renewal

15.1. Payment for services is processed through LiqPay or via a PDF invoice (payment through banking institutions).

15.2. For online payments, transaction processing is carried out exclusively on the side of the LiqPay payment service. The Portal does not store full payment card details and receives only the technical data required to record the payment.

15.3. After a successful online payment, the account status is updated automatically.

15.4. The user is responsible for the accuracy of the payment details entered during online payment.

15.5. In case of an unsuccessful online transaction, the user receives a corresponding notification by email.

15.6. Cost of services:

  • “Basic” plan — 2500 UAH / year. Suitable for small sites, landing pages, and business cards.

  • “Professional” plan — 3500 UAH / year. Optimal for business sites, corporate pages, and sites with moderate traffic.

  • “Premium” plan — 5000 UAH / year. Suitable for multi-page sites, catalogs, and resources with increased load.

All plans include:

  • site hosting on the server (Hosting Ukraine, location — Germany);

  • backup copies;

  • access via the clients.kaplia.pro portal;

  • protection against attacks and infrastructure updates;

  • technical monitoring and support.

15.7. Domain prices. The cost of domains is generated automatically and depends on the tariffs of the registrar “Hosting Ukraine”. Prices for the most popular domain zones:

Prices for domains in less popular zones are available on the registrar’s website.

15.8. Payment via PDF invoice. The user may choose to pay via a generated PDF invoice. In this case, the Portal automatically generates an invoice according to the selected client type (individual, sole proprietor, or legal entity) and sends it to the contact email address specified in the account settings. Invoice payment is made by the user independently through banking institutions. The account status is updated after the actual receipt of funds.

16. Refund Policy

16.1. Refunds are only possible in cases where the service has not yet been provided. If the account service (hosting, domain) has already been activated, a refund is not possible.

16.2. Refunds are possible within 14 calendar days from the date of payment, provided that:

  • the service has not yet been activated;

  • no website setup or technical support work has started;

  • the domain has not been registered (refunds for domains are not possible under registrar rules).

16.3. To request a refund, the client must submit a request to support through the Portal. The request is reviewed within 1–2 business days.

16.4. Refunds are issued to the same card or account used for the payment.

16.5. In case of a technical error during payment, a possible duplicate charge, or incorrect payment processing, the Owner undertakes to resolve the situation and return any excess funds.

17. Data in the Portal

17.1. All data in an account (websites, backups, mailboxes, payment history, support requests) is confidential.

17.2. Users can change their email, name, and phone number in their profile settings.

17.3. Deleting an account removes data only within the Portal and does not affect actual resources on the hosting.

18. Technical Support and Live Chat

18.1. Support requests are submitted through the built-in support form and the chat widget. Support is provided to authorized users only.

18.2. The user acknowledges that the Owner can see whether they are currently online in the Portal.

18.3. Support requests and chat messages must not contain:

  • aggressive messages, obscene language, or threats;

  • spam and advertising materials;

  • information unrelated to the services provided.

18.4. Requests containing inappropriate content, spam, or technically meaningless queries may be ignored.

19. Invitation System

19.1. A user can gain access to an account through a personal invitation link. After following the link and signing in, access is granted automatically.

19.2. The user agrees that:

  • an invitation is personal access and must not be shared with third parties without the account owner’s consent;

  • if the invitation is shared, access to the account will be granted to everyone who follows the link and signs in;

  • the account owner bears responsibility for the consequences of such sharing;

  • an invitation may be deactivated by the Owner at any time.

20. Prohibitions

In the Portal, it is prohibited to:

  • use the Portal for actions unrelated to your own resources;

  • bypass security systems;

  • perform mass automated requests;

  • reverse-engineer the Portal or any of its parts;

  • exploit bugs and vulnerabilities for personal gain.
